Protect Yourself with a Buyer’s Agent: Good Reason #1
Sometimes I hear home buyers say that they don’t really need a buyer’s agent. And honestly, a lot of people don’t. There is
absolutely nothing wrong with walking into an open house, or calling the phone number on the For Sale sign, and then deciding that you’d actually like to make an offer on the house.
I don’t begrudge home buyers who would prefer to do it this way in the least.
I will share with you in this, and future blog posts, the reasons however, that folks who DO like to use a Buyer’s Agent, give me.
You can make sure your Buyer’s Agent is contractually obligated to represent you:
If you use a separate agent, other than the one who’s being paid to sell the house, you are being represented by someone who is representing you and only you.
In fact, in Colorado, you can insist on a signed Buyer’s Agency agreement which means that legally, the agent is bound to represent you and your best interests.
Further, Colorado’s contract, when a Buyer’s Agency exists, states that the buyer’s agent must:
promote the buyer’s interests with the utmost good faith, loyalty and fidelity
AND
seek a price and terms that are acceptable to the buyer
AND
counsel buyer as to any material benefits or risks of a transaction that are actually known by the agent
